Man, I just had to post this true story out of Illinois!!

There is no way to make this stuff up!!

Dear Mr. Limbaugh,

I was speaking to an emergency room physician this morning. He told me that a woman in her 20's came to the ER with her 8th pregnancy. She stated "my momma told me that I am the breadwinner for the family." He asked her to explain. She said that she can make babies and babies get money for the family. The scam goes like this: The grandma calls the Department of Child and Family Services and states that the unemployed daughter is not capable of caring for these children. DCFS agrees and states that the child or children will need to go to foster care. The grandma then volunteers to be the foster parent, and thus receives a check for $1500 per child per month in Illinois. Total yearly income: $144,000 tax-free, not to mention free healthcare (Medicaid) plus a monthly "Linx" card entitling her to free groceries, etc, and a voucher for 250 free cell phone minutes per month. This does not even include Wick and other welfare programs. Indeed, grandma was correct in that her fertile daughter is the "breadwinner" in the family.

I hope you share this story with your listeners so that they know how the ruling class spends their tax dollars.

Something Funny Is Going On!!

The Morgans: Private International Bankers, 1854--1913 (Harvard Studies in Business History)

A friend of mine pointed me to this article by Alfred Adask and I have to share it. Great piece to share with those that deny the truth.
This supports a previous post of mine about THE UNITED STATES de facto corporation, and provides a few more shocking details!!

"Somethin' Funny's Goin' On"

The Manta.com website includes a database of over 63 million US and foreign companies. That database info is provided by Dunn & Bradstreet (D&B). Manta.com will provide preliminary information on each of these millions of companies for free. If you want more "in-depth" info, there's a fee.

But since this article is about "funny" stuff, and paying fees isn't fun, let's run a few free searches and see what we can find. You might be surprised.

For example, if you type "Government of the United States" into the Manta.com search engine, you'll be whisked to a list of "7,666 matching US companies".

The first "company" on the list is:

"Government of the United States (US Government) HQ

"the u.s. Capitol Washington DC"

The "HQ" stands for "headquarters".

If you scroll down the list of other companies below the "Government of the United States," you'll find "branches" like "Executive Office of the United States Government" (6 entries), "United States Department of the Air Force (US Government)," "The Navy United States Department of (US Government Naval Reserves)," and "United States Court of Appeals For The 11th Circuit United States Courthouse".

Apparently, the Navy, Air Force and Courts are "companies".

That's kinda "funny," doncha think?

If you click on the "Government of the United States HQ" link, you'll see another website page with some fairly detailed—and possibly bewildering—information.

For example, you'll see that this "Government of the United States" has its address at:

"the u.s. capitol

"Washington, DC 20515-0001"

Its phone number is "(202) 224-3121". Business Hours are "24/7".

You can click the "map" link and see a graphic indicating that this "Government" is located on "Capitol Hill" (same place as Congress) in Washington DC.

None of that seems particularly surprising (other than the idea that our "Government" might be a "company" and/or a conglomerate of "companies"). But the Manta.com report does begin to seem a little strange under the heading "About Government Of The United States" where we read:

"government, owner archbishop deric r. mccloud of basilica shrine michigan and 4th ne street washington,dc".

Say whut? Does that abbreviated text really indicate that the owner of the "Government Of The United States" is an archbishop named Deric R. McCloud? Who could be dumb enough to think (or even mistakenly write) that the "Government of the United States" was owned by an archbishop?

A: Apparently, Dunn & Bradstreet was dumb enough.

And just in case you think we can't be talking about the "Government of the United States," take a gander at the "Additional Information" heading and you'll read (as of August 6th, A.D. 2010):"all receipents [sic] of federal funds that have any kind of criminal case or felony federal, state, local or served time in prison federal, state, benefits terminate 7/26/10 by barack obama administration."
The reference to "barack obama" shows that this entry for "Government of the United States HQ" does, indeed, describe the very same "Government of the United States" that we all so love and admire. (Don't forget that this "Government" and all its various "branches" are being reported by D&B to be individual, private companies.)

OK, OK—maybe this article isn't really all that "funny" (ha-ha!), but it's still pretty "funny" (strange).

• Go back to the top of the "Government of the United States" page and click the "More Info" tab. Under "Employees (Estimated)" you'll read:

"2,768,886"At this location

"3"
2.7 million federal employees sounds about right. This enormous number of employees confirms that we're viewing information on the "Government of the United States".

But if only "3" of those millions of employees are "At this location" (the "HQ") who are the "chosen 3"? And where, precisely is "this location"? Capitol Hill? Yes—but where on Capitol Hill? In the Senate chamber? The House of Representatives? If there are only "3" people at the HQ, that HQ might be as small as some cloakroom.

Curiouser and curiouser.

Under "State of Incorporation" you'll read "Information not found". This could mean that this "Government of the United States" was never formally "incorporated". Or it might mean that the information concerning that incorporation is intentionally concealed.

However, we can see a clue to the possible date of incorporation for this "Government of the United States" under the heading "Years in Business" which reads "223". If the "Government of the United States" began 223 years ago, there should be a constitution or charter to mark its creation at that time.

This is A.D. 2010, so "223" years ago would be A.D. 1787.

But that's odd.

Why? Because our current "Government of the United States" should have been created by "The Constitution of the United States" and therefore could not have existed prior to the ratification of the Constitution.

In A.D. 1787, the Constitutional Convention completed the final draft of the Constitution on September 17th. That proposed Constitution for a new "federal government" was then submitted to the Congress that already existed under the Articles of Confederation (ratified in A.D. 1781). The Confederation Congress quickly "approved" the proposed Constitution under Article 13 of the Articles of Confederation and then sent it out to We the People for ratification.

Article VII of the Constitution declares, "The Ratification of the Conventions of nine States, shall be sufficient for the Establishment of this Constitution between the States so ratifying the Same." I.e., the Constitution (and resulting federal government) could not become effective and operational until it was ratified by at least nine of the States of the Union.

Thus, while the Constitution may have been "approved" by the existing Congress in A.D. 1787, it could not have been established and ordained by We the People until ratified by at least 9 States. But the 9th State (New Hampshire) didn't ratify until June 21st, A.D. 1788.

Wikipedia article "Unites States Constitution" reports:

"Once the Congress of the Confederation received word of New Hampshire's ratification, it set a timetable for the start of operations under the new Constitution, and on March 4, 1789, the [new, federal] government began operations." [Bracketed insertion mine.]

Since the Constitution created the federal "Government" and could not have been ratified by We the People before A.D. 1788 (when the 9th State ratified), D&B's report that the "Government of the United States" began "223" years ago (A.D. 1787) can't be true. The earliest that the Constitution could've been deemed ratified and operations was A.D. 1788—222 years ago. Similarly, given that the new federal "Government" was not actually operational until A.D. 1789, the D&B report that this "Government" has been "in business" since A.D. 1787 also seems mistaken. Under this criteria, the earliest that the federal Government might become operational was A.D. 1789—221 years ago.

Big deal, hmm?

Who cares?

Aren't I merely making a mountain out of data entry error mole hill? Didn't the D&B clerk responsible for the data entry simply write "223" when she meant "222" or even "221"?

I doubt it. If I'm right, it is a "big deal". Here's why:

In A.D. 2008, I first learned about the Manta.com reports that suggest our government is some sort of conglomerate of "companies" and "branches". When I first read the D&B "Government of the United States" report two years ago, Manta.com had a different website format. In that earlier format, Manta.com reported that "Government of the United States" started in "1787". (Today, they report "223" years in business.)

In 2008, when I first saw "1787," I knew that either: 1) the D&B data entry clerk made a mistake; or 2) the current "Government of the United States" is somehow presumed to have started at least one year before the Constitution itself was ratified and two years before the resulting federal government became operational.

If so, whatever currently passes for our "Government of the United States" is not based on the authority of We the People, but on some other "authority". Thus, this is a potentially "big" deal.

I also knew that if the D&B clerk didn't make a data entry error, that the Manta.com website might be changed to eliminate evidence that today's "Government of the United States" is not be the same "Government" created by the Constitution ratified by People in A.D. 1788. So, in A.D. 2009, I downloaded and retained complete copies of about 25 Manta.com website pages for safekeeping.

As I'd anticipated, the Manta.com website has since been modified and some information found two years ago has been changed or "disappeared".

For example, where Manta.com used to report that the "Government" began in "1787," it now reports that it's been in business for "223" years. That's not a big change. It's still possible that the numbers "223" and "1787" simply reflect some persistent data entry calculation error. But given the differences between "1787" and "223," the probability of a mere data entry error is reduced. It therefore seems increasingly possible that the current D&B report on "Government of the United States" may correctly declare that that "Government" started the year before the Constitution was ratified by the People.

If so, as crazy as it sounds, it is therefore conceivable that there might be two editions of our "Constitution": 1) one approved by the Confederation Congress in A.D. 1787; and 2) another, ratified by We the People in A.D. 1788. The text of both of these "editions" of the Constitution would be identical, but the underlying authority would be completely different.

Under the Constitution ratified by People in A.D. 1788, the enacting authority and national sovereigns would (consistent with the principles of the "Declaration of Independence") be We the People. As individual sovereigns, We the People would enjoy the "republican form of government" guaranteed at Article 4 Section 4 of the federal Constitution.

However, under the possible Constitution "approved" by Congress in A.D. 1787, the enacting authority and national sovereigns would be the Congress. If Congress were the constitutional sovereign, our form of government would be an aristocracy of 535 men and women. Worse, under such aristocracy, you and I would be presumed to be subjects or even slaves. If the Constitution "approved" by Congress in A.D. 1787 were in effect today (rather than the Constitution ratified by the People in A.D. 1788), you and I can't be free.

Yes, this conjecture sounds like another howling conspiracy theory. But even so, since the Constitution wasn't ratified until A.D. 1788 and the resulting government didn't become operational until A.D. 1789, D&B's report that the government began "223" years ago and/or began in "1787" can't be accurate. So, it seems at least "odd" that an entity as professional a D&B would make such a peculiar error.

It's also curious that D&B describes the "Government of the United States" as a company and "HQ" over a number of other "branches" (like the Army, Navy, Air Force and courts) that are also deemed to be "companies".

Somethin' funny's goin' on here.

• If you're up for even more funny stuff, enter "Nancy Pelosi" into the Manta.com search engine. You'll be taken to a list of "2 matching U.S. companies":

1) "United States House of Representatives (Congresswoman Nancy Pelosi) BRANCH" at her San Francisco address; and2) "Representative Nancy Pelosi (Congresswoman Nancy Pelosi) BRANCH" at her Washington DC address.
Click the #1 link, look for the heading "About United States House of Representatives," and you'll read:

"United States House Of Representatives is a private company categorized under Legislative Bodies, National and located in San Francisco, CA . . . ."

Whut th' . . . ?!

The US House of Representative is "a private company"?! And it's "located in San Francisco, CA" (the home of the Speaker of the House)?

More?

Look under the heading "United States House of Representatives Business Information" and you'll read:"United States House Of Representatives also does business as Congresswoman Nancy Pelosi."
The House of Representatives not only "does business" but does so "as Congresswoman Nancy Pelosi"? Is "Nancy Pelosi" something like a trademark, alter ego or registered agent for the "private company" we call the "House of Representatives"? Is she the CEO and/or D/B/A for the House of Representatives, Inc.?

Incidentally, the 2009 edition of Manta.com's report on Nancy Pelosi (that I recorded and saved) declared that the US House of Representatives was "also traded as Nancy Pelosi".

Also traded as?! What does that mean? Are we talking about packages of bubble gum that include government "trading cards" featuring photos of the House of Representatives and Nancy Pelosi? Or is the House of Representatives and/or Nancy Pelosi some sort of stock? If so, who's buying, who's selling? Who owns that "company"?

• Enter "US Social Security Admin" into the search engine. Scroll down a bit and you'll read:"US Social Security Admin is a private company categorized under Federal Government-Social and Human Resources and located in West Branch, MI."
So-So Security is a "private company" . . . ? That's not located in Washington DC, but rather in "West Branch, MI" . . . ? I don't know what that means, but I can't help but laugh. Somethin' funny is goin' on here.

• Try "Internal Revenue Service". Manta.com will produce "41,632 matching U.S. companies". Some of these are clearly private entities that have no governmental pretense, but many or most are "governmental".

If you click the link to "Internal Revenue Service, Internal Revenue Dst Council," you'll read "Internal Revenue Service is a private company categorized under Federal Goverenment-Finance and Taxation and located in Portland, OR."

Click the "Internal Revenue Service, Andover Service Center . . . . Andover MA" link and you'll read that "Internal Revenue Service is a private company categorized under Federal Government-Finance and Taxation and located in Andover, MA."

Two different locations indicate two different "private companies".

These reports (and scores more) suggest that each individual IRS office may be a separate "private company". Therefore, if you're contacted by an IRS office in Austin, Texas, you may be dealing with one "private company". If you're subsequently contacted by another IRS office from, say, Provo, Utah—you might be dealing with a completely different "private company".

What's your obligation to talk to several different "private companies" about your income taxes? Are there privacy concerns in sharing your tax information with several private companies?

And given that there are at least several score (and perhaps several thousand) "private companies," operating as an "Internal Revenue Service," who are you really paying your income taxes to? H&R Block?

• There are a host of additional "private companies" that you might want to research. I collected website pages for about two dozen in 2008 and 2009. I'm not sure how many of those can still be found, but if you can find `em and if you read closely, you may be fascinated. Search for: "United States Court of Appeals," "District of Columbia," "George W Bush," and "Supreme Court of the United States". All were listed by D&B as "private companies".

You may find other D&B reports that are similarly fascinating or bewildering. What does D&B have to say about the CIA or Homeland Security? Inquiring minds wanna know.

• What's it all mean? I'm not sure. Perhaps D&B is merely guilty of gross negligence when it comes to entering data on governmental entities.Or, maybe the entire structure of what currently passes for "government" is actually a conglomerate of "private companies" run by an aristocratic Congress that's owned by . . . who? The world's bankers?
If so, the true nature of the "Government of the United States" might not be that of a "republic" or even a "democracy," but rather a combination of governmental and corporate interests ("private companies") that's usually described as "fascism". If so, we no longer have "government of the People, by the People and for the People" but instead have "government of the people, by the Congress, and for the Corporations."

Whatever the explanation, somethin' funny is goin' on here.

Today, when it comes to government, an appearance of reality appears to have been substituted for reality. Our government is not what it appears to be; not what it professes to be—and that's not funny at all, is it?

Before we get to the posted article. I want to go back into history of this CFR controlled country, and give a back drop about how and why Cannabis was demonized, through the court of public opinion, and then finally outlawed by legislation.

The two key opponents to Cannabis, or what is incorrectly labeled as marijuana, were Harry Anslinger and William Randolph Hearst, a newspaper and timber magnet.

Where did the word 'marijuana' come from? In the mid 1930s, the M-word was created to tarnish the good image and phenomenal history of the hemp plant...as you will read and see from the video. The facts cited here, with references, are generally verifiable in the Encyclopaedia Britannica which was printed on hemp paper for 150 years:

The following information comes directly from the United States Department of Agriculture's 1942 14-minute film encouraging and instructing 'patriotic American farmers' to grow 350,000 acres of hemp each year for the war effort: '...(When) Grecian temples were new, hemp was already old in the service of mankind. For thousands of years, even then, this plant had been grown for cordage and cloth in China and elsewhere in the East. For centuries prior to about 1850, all the ships that sailed the western seas were rigged with hempen rope and sails. For the sailor, no less than the hangman, hemp was indispensable... ...Now with Philippine and East Indian sources of hemp in the hands of the Japanese...American hemp must meet the needs of our Army and Navy as well as of our industries... ...the Navy's rapidly dwindling reserves. William Randolph Hearst (Citizen Kane) and the Hearst Paper Manufacturing Division of Kimberly Clark owned vast acreage of timberlands. The Hearst Company supplied most paper products. Patty Hearst's grandfather, a destroyer of nature for his own personal profit, stood to lose billions because of hemp. In 1937, DuPont patented the processes to make plastics from oil and coal. DuPont's Annual Report urged stockholders to invest in its new petrochemical division. Synthetics such as plastics, cellophane, celluloid, methanol, nylon, rayon, Dacron, etc., could now be made from oil. Natural hemp industrialization would have ruined over 80% of DuPont's business. THE SWITCH Andrew Mellon became Hoover's Secretary of the Treasury and DuPont's primary investor. He appointed his future nephew-in-law, Harry J. Anslinger, to head the Federal Bureau of Narcotics and Dangerous Drugs. Secret meetings were held by these financial tycoons. Hemp was declared dangerous and a threat to their billion dollar enterprises. For their dynasties to remain intact, hemp had to go. These men took an obscure Mexican slang word: 'marihuana' and pushed it into the consciousness of America. MANIPULATION & CRONYISM A media blitz of 'yellow journalism' raged in the late 1920s and 1930s. Hearst's newspapers ran stories emphasizing the horrors of marihuana. The menace of marihuana made headlines. Readers learned that it was responsible for everything from car accidents to loose morality. Films like 'Reefer Madness' (1936), 'Marihuana: Assassin of Youth' (1935) and 'Marihuana: The Devil's Weed' (1936) were propaganda designed by these industrialists to create an enemy. Their purpose was to gain public support so that anti-marihuana laws could be passed. Examine the following quotes from 'The Burning Question' aka REEFER MADNESS: *a violent narcotic. *acts of shocking violence. *incurable insanity. *soul-destroying effects. *under the influence of the drug he killed his entire family with an axe. *more vicious, more deadly even than these soul-destroying drugs (heroin, cocaine) is the menace of marihuana! Reefer Madness did not end with the usual 'the end.' The film concluded with these words plastered on the screen: TELL YOUR CHILDREN. In the 1930s, people were very naive; even to the point of ignorance. The masses were like sheep waiting to be led by the few in power. They did not challenge authority. If the news was in print or on the radio, they believed it had to be true. They told their children and their children grew up to be the parents of the baby-boomers. On April 14, 1937, the Prohibitive Marihuana Tax Law or the bill that outlawed hemp was directly brought to the House Ways and Means Committee. This committee is the only one that can introduce a bill to the House floor without it being debated by other committees. The Chairman of the Ways and Means, Robert Doughton, was a DuPont supporter. He insured that the bill would pass Congress. Dr. James Woodward, a physician and attorney, testified too late on behalf of the American Medical Association. He told the committee that the reason the AMA had not denounced the Marihuana Tax Law sooner was that the Association had just discovered that marihuana was/is hemp. Few people, at the time, realized that the deadly menace they had been reading about on Hearst's front pages was in fact passive hemp. The AMA understood hemp to be a MEDICINE found in numerous healing products sold over the last hundred years. In September of 1937, hemp became illegal. The most useful crop known became a drug and our planet has been suffering ever since. Congress banned hemp because it was said to be the most violence-causing drug known. Anslinger, head of the Drug Commission for 31 years, promoted the idea that marihuana made users act extremely violent. In the 1950s, under the Communist threat of McCarthysim, Anslinger now said the exact opposite. Marijuana will pacify you so much that soldiers would not want to fight. Today, our planet is in desperate trouble. Earth is suffocating as large tracts of rain forests disappear. Pollution, poisons and chemicals are killing people. The plant grows quickly to maturity in a season where trees take a lifetime. ALL PLASTIC PRODUCTS SHOULD BE MADE FROM HEMP SEED OIL. Hempen plastics are biodegradable! Over time, they would break down and not harm the environment. Oil-based plastics, the ones we are very familiar with, help ruin nature; they do not break down and will do great harm in the future. The process to produce the vast array of natural (hempen) plastics will not ruin the rivers as DuPont and other petrochemical companies have done. Ecology does not fit in with the plans of the Oil Industry and the political machine. Hemp products are safe and natural. MEDICINES SHOULD BE MADE FROM HEMP. We should go back to the days when the AMA supported hemp cures. 'Medical Marijuana' is given out legally to only a handful of people while the rest of us are forced into a system that relies on chemicals. Hemp is only healthy for the human body. WORLD HUNGER COULD END. A large variety of food products can be generated from hemp. The seeds contain one of the highest sources of protein in nature. ALSO: They have two essential fatty acids that clean your body of cholesterol. These essential fatty acids are not found anywhere else in nature! Consuming hemp seeds is the best thing you could do for your body. Eat uncooked hemp seeds. CLOTHES SHOULD BE MADE FROM HEMP. Hemp clothing is extremely strong and durable over time. You could hand clothing, made from hemp, down to your grandchildren. Today, there are American companies that make hemp clothing; usually 50% hemp. Hemp fabrics should be everywhere. It has been in circulation on the web, but I felt it was fitting and relevant to post.

Charlie Reese, a retired reporter for the Orlando Sentinel, has hit the nail directly on the head, defining clearly who it is, that, in the final analysis, must assume responsibility for the judgments made that impact each one of
us.

545 vs. 300,000,000

Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits?

Have you ever wondered, if all the politicians are against inflation and high taxes, WHY do we have inflation and high taxes?

You and I don't propose a federal budget. The President does. (Oh, my!! And we have to depend on Obama, Organizer in Chief, to propose a fiscal budget, and he has never ran a company in his lifetime!!)
You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does.

You and I don't write the tax code, Congress does.

You and I don't set fiscal policy, Congress does.

You and I don't control monetary policy, the Federal Reserve Bank does.

One hundred senators, 435 congressmen, one president, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country.

I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank. ("Give me control of a nations currency, and I care not for who writes its laws"~ Amschel Mayer Bauer Rothschild)
I excluded all the special interests and lobbyists for a sound reason. They have no legal authority. They have no ability to coerce a senator, a congressman, or a president to do one cotton-picking thing. I don't care if they offer a politician $1 million dollars in cash, the politician has the power to accept or reject it. No matter what the lobbyist promises, it is the legislator's responsibility to determine how he/she votes.

Those 545 human beings spend much of their energy convincing you that what they did is not their fault. They cooperate in this common con regardless of party.
What separates a politician from a normal human being is an excessive amount of gall. No normal human being could have the gall of a Speaker, who stood up and criticized the President for creating deficits. The President can only propose a budget. He cannot force the Congress to accept it.

The Constitution, which is the Supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. House members, not the President, can approve any budget they want. If the president vetoes it, they can pass it over his veto if they agree to.
It seems inconceivable to me that a nation of 300 million can not replace 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility. I can't think of a single domestic problem that is not traceable directly to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.

If the tax code is unfair, it's because they want it unfair.

If the budget is in the red, it's because they want it in the red.

If the Army and Marines are in Iraq, it's because they want them in Iraq.

If they do not receive social security but are on an elite retirement plan not available to the people, it's because they want it that way.

There are no insoluble government problems.

Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power. Above all, do not let them con you into the belief that there exists disembodied mystical forces like "the economy," inflation," or "politics" that prevent them from doing what they take an oath to do.

Those 545 people, and they alone, are responsible.

They, and they alone, have the power.

They and they alone, should be held accountable by the people, who are their bosses, provided the voters have the gumption to manage their own employees. ( I beg to differ with Charlie on this statement)

Vote all fiscally irresponsible politicians out of office and clean up their mess! (It will take more than voting the rascals out, since both parties work for the same bosses!)

It's now or never, we must save America before it's too late!

I want to cover a document here, and it is the basis for the blog about Erie Railroad v. Tompkins, 1938.

What you will read below is FACT. No conspiracy BS going on with the events that transpired.

The facts contained herein were never taught in History or Civic, or whatever they, (Dept. of Edu), want to call it today.

THE UCC CONNECTION

FOREWORD

This is slightly condensed, casually paraphrased transcript of tapes of a seminar given in 1990 by Howard Freeman. It was prepared to make available the knowledge and experience of Mr. Freeman in his search for an accessible and understandable explanation of the confusing state of the government and the courts. It should be helpful to those who may have difficulty learning from such lectures, or those who want to develop a deeper understanding of this information without having to listen to three or four hours of recorded material.

The frustration many Americans feel about our judicial system can be overwhelming and often frightening; and like most fear, eventually, with the seemingly tyrannical power of some governmental agency and the mystifying and awesome power of the courts. We have been taught that we must "get a good lawyer," but that is becoming increasingly difficult, if not impossible. If we are defending ourselves from the government, we find that the lawyers quickly take our money, and then tell us as the ship is sinking, "I can't help you with that - I'm an officer of the court."

Ultimately, the only way for us to have even a "snowball's chance …" is to understand the RULES OF THE GAME, and to come to an understanding of the true nature of the Law. The attorney lawyers have established and secured a virtual monopoly over this area of human knowledge by implying that the subject is just too difficult for the average person to understand, and by creating a separate vocabulary out of English words of otherwise common usage. While it may, at times, seem hopelessly complicated, it is not that difficult to grasp - are lawyers really as smart as they would have us believe? Besides, anyone who has been through a legal battle against the government with the aid of a lawyer has come to realize that lawyers learn about procedure, not about law. Mr. Freeman admits that he is not a lawyer, and as much, he has a way of explaining law to us that puts it well within our reach. Consider also that the framers of the Constitution wrote in language simple enough that the people could understand, specifically so that it would not have to be interpreted.

So again we find, as in many other areas of life, that "THE BUCK STOPS HERE!" It is we who must take the responsibility for finding and putting to good use the TRUTH. It is we who must claim and defend our God-given rights and our freedom from those who would take from us. It is we who must protect ourselves, our families and our posterity from the inevitable intrusion into our lives by those who live parasitically off the labor, skill and talents of others.

To these ends, Mr. Freeman offers a simple, hopeful explanation of our plight and a peaceful method of dealing with it. Please take note that this lecture represents one chapter in the book of his understanding, which he is always refining, expanding, improving. It is, as all bits of wisdom are, a point of departure from which to begin our own journey into understanding, that we all might be able to pass on to others; greater knowledge and hope, and to God: the gift of lives in peace, freedom and praise.

INTRODUCTION

I was asked to testify in a tax case as an expert witness. After many days of preparation, I felt confident of my research. I spent over 30 minutes presenting many Supreme Court decisions that supported the defendant's position. The prosecution concluded his statements, and to my amazement, the judge told the jury that they could only consider certain facts, none of which were the facts I had given.

As soon as the trial was over I went around to the judge's office and he was just coming in through his back door. I said, "Judge, by what authority do you overturn the standing decisions of the United States Supreme Court. You sat on the bench while I read that case law. Now how do you, a District Judge, have authority to overturn decisions of the Supreme Court?" He says. "Oh, those were old decisions." I said, "Those are standing decisions. They have never been overturned. I don't care how old they are; you have no right to overturn a standing decision of the United States Supreme Court in a District Court."

PUBLIC LAW V. PUBLIC POLICY

He said, "Name any decision of the Supreme Court after 1938 and I'll honor it, but all the decisions you read were prior to 1938, and I don't honor those decisions." I asked what happened in 1938. He said, "Prior to 1938, the Supreme Court was dealing with Public Law; since 1938, the Supreme Court has dealt with Public Policy. The charge that Mr. S. was being tried for is a Public Policy Statute, not Public Law, and those Supreme Court cases do not apply to Public Policy." I asked him what happened in 1938? He said that he had already told me too much - he wasn't going to tell me any more.

1938 AND THE ERIE RAILROAD

Well, I began to investigate. I found that 1938 was the year of the Erie Railroad v. Tompkins case of the Supreme Court. It was also the year the courts claim they blended Law with Equity. I read the Erie Railroad case. A man had sued the Erie Railroad for damages when he was struck by a board sticking out of a boxcar as he walked along beside the tracks. The district court had decided on the basis of Commercial (Negotiable Instruments) Law: that this man was not under any contract with the Erie Railroad, and therefore he had no standing to sue the company. Under the Common Law, he was damaged and he would have had the right to sue.

This overturned a standing decision of over one hundred years. Swift v. Tyson in 1840 was a similar case, and the decision of the Supreme Court was that in any case of this type, the court would judge the case on the Common Law of the state where the incident occurred - in this case Pennsylvania. But in the Erie Railroad case, the Supreme Court ruled that all federal cases will be judged under the Negotiable Instruments Law. There would be no more decisions based on the Common Law at the federal level. So here we find the blending of Law with Equity.

This was a puzzle to me. As I put these new pieces together, I determined that all our courts since 1938 were Merchant Law courts and not Common Law courts. There were still some pieces of the puzzle missing.

A FRIEND IN THE COURT

Fortunately, I made a friend of a judge. Now you won't make friends with a judge if you go into court like a "wolf in black sheep country." You must approach him as though you are the sheep and he is the wolf. If you go into court as a wolf, you make demands and tell the judge what the law is - how he had better uphold the law or else. Remember the verse: I send you out as sheep in wolf country; be wise as a serpent and harmless as a dove. We have to go into court and be wise and harmless, and not make demands. We must play a little dumb and ask a lot of questions. Well, I asked a lot of questions and boxed the judges into a corner where they had to give me a victory or admit what they didn't want to admit. I won the case, and on the way out I had to stop by the clerk's office to get some papers. One of the judges stopped and said, "You're an interesting man, Mr. Freeman. If you're ever in town, stop by, and if I'm not sitting on a case we will visit.

AMERICA IS BANKRUPT

Later, when I went to visit the judge, I told him of my problem with the Supreme Court cases dealing with Public Policy rather than the Public Law. He said, "In 1938, all the higher judges, the top attorneys and the U.S. attorneys were called into a secret meeting and this is what we were told:

America is a bankrupt nation - it is owned completely by its creditors. The creditors own the Congress, they own the Executive, they own the Judiciary and they own all the state governments.

Take silent judicial notice of this fact, but never reveal it openly. Your court is operating in an Admiralty Jurisdiction - call it anything you want, but do not call it Admiralty.

ADMIRALTY COURTS

The reason they cannot call it Admiralty Jurisdiction is that your defense would be quite different in Admiralty Jurisdiction from your defense under the Common Law. In Admiralty, there is no court which has jurisdiction unless there is a valid international contract in dispute. If you know it is Admiralty Jurisdiction, and they have admitted on the record that you are in Admiralty Court, you can demand that the international maritime contract, to which you are supposedly a party, and which you supposedly have breached, be placed into evidence.

No court has Admiralty/Maritime Jurisdiction unless there is a valid international maritime contract that has been breached.

So you say, just innocently like a lamb, "Well, I didn't know that I got involved with an international maritime contract, so, good faith, I deny that such a contract exists. If this court is taking jurisdiction in Admiralty, then, pursuant to section 3-501 of your UCC, (Presentment), the prosecutor will have no difficulty placing the [alleged] contract into evidence, so that I may examine and [possibly] challenge the validity of the contract." What they would have to do is place the national debt into evidence. They would have to admit that the international bankers own the whole nation, and that we are their slaves.

NOT EXPEDIENT

But the bankers said it is not expedient at this time to admit that they own everything and could foreclose on every nation of the world. The reason they don't want to tell everyone that they own everything is that there are still too many privately owned guns. There are uncooperative armies and other military forces. So until they can gradually consolidate all armies into a WORLD ARMY and all courts into a single WORLD COURT, it is not expedient to admit the jurisdiction the courts are operating under. When we understand these things, we realize that there are certain secrets they don't want to admit, and we can use this to our benefit.

JURISDICTION

The Constitution of the United States mentions three areas of jurisdiction in which the courts may operate:

Common Law

Common Law is based on God's law. Anytime someone is charged under the Common Law, there must be a damaged party. You are free under the Common Law to do anything you please, as long as you do not infringe on the life, liberty, or property of someone else. You have a right to make a fool of yourself provided you do not infringe on the life, liberty, or property of someone else. The Common Law does not allow for any government action, which prevents a man from making a fool of himself. For instance, when you cross over the state lines in most states, you will see a sign, which says, " BUCKLE YOUR SEAT BELTS - IT'S THE LAW. " This cannot be Common Law, because who would you injure if you did not buckle up? Nobody. This would be compelled performance. But Common Law cannot compel performance. Any violation of Common Law is a CRIMINAL ACT, and is punishable.

Equity Law

Equity Law is law which compels performance. It compels you to perform to the exact letter of any contract that you are under. So, if you have compelled performance, there must be a contract somewhere, and you are being compelled to perform under the obligation of the contract. Now this can only be a civil action - not criminal. In Equity Jurisdiction, you cannot be tried criminally, but you can be compelled to perform to the letter of a contract. If you then refuse to perform as directed by the court, you can be charged with contempt of court, which is a criminal action. Are our seatbelt laws, Equity Laws? No, they are not, because you cannot be penalized or punished for not keeping to the letter of a contract.

Admiralty/Maritime Laws

This is civil jurisdiction of Compelled Performance which also has Criminal Penalties for not adhering to the letter of the contract, but this only applies to International Contracts. Now we can see what jurisdiction the seatbelt laws (all traffic codes, etc) are under. Whenever there is a penalty for failure to perform (such as willful failure to file), that is Admiralty/Maritime Law and there must be a valid international contract in force.

However, the courts don't want to admit that they are operating under Admiralty/Maritime Jurisdictions, so they took the international law or Law Merchant and adopted it into our codes. That is what the Supreme Court decided in the Erie Railroad case - that the decisions will be based on commercial law or business law and that it will have criminal penalties associated with it. Since they were instructed not to call it, Admiralty Jurisdiction, they call it Statutory Jurisdiction.

COURTS OF CONTRACT

You must ask how we got into this situation where we can be charged with failure to wear seatbelts and be fined for it. Isn't the judge sworn to up hold the Constitution? Yes, he is. But you must understand the Constitution, in Article I, § 10, gives us the unlimited right to contract, as long as we do not infringe on the life, liberty or property of someone else. Contracts are enforceable, and the Constitution gives two jurisdictions where contracts can be enforced - Equity or Admiralty. But we find them being in Statutory Jurisdiction. This is the embarrassing part for the courts, but we can use this to box the judges into a corner in their own courts. We will cover this more later.

CONTRACTS MUST BE VOLUNTARY

Under the Common Law, every contract must be enter into knowingly, voluntarily, and intentionally by both parties or it is void and enforceable. These are characteristic -it must be based on substance. For example, contracts used to read, "For one dollar and other valuable considerations, I will paint your house, etc. That was a valid contract - the dollar was a genuine, silver dollar. Now, suppose you wrote a contract that said, "For one Federal Reserve Note and other considerations, I will paint your house...." And suppose, for example, I painted your house the wrong color. Could you go into a Common Law court and get justice? No, you could not. You see, a Federal Reserve Note is a "colorable"1 dollar, as it has no substance, and in a Common Law Jurisdiction, that contract would be unenforceable.

colorABLE MONEY - colorABLE COURTS

The word "colorable" means something that appears to be genuine, but is not. Maybe it looks like a dollar, and maybe it spends like a dollar, but if it is not redeemable for lawful money (silver or gold) it is "colorable." If a Federal Reserve Note is used in a contract, then the contract becomes a "colorable" contract. And "colorable" contracts must be enforced under a "colorable" jurisdiction. So by creating Federal Reserve Notes, the government had to create a jurisdiction to cover the kinds of contracts which use them. We now have what is called Statutory Jurisdiction, which is not a genuine Admiralty jurisdiction.

It is " colorable " Admiralty Jurisdiction the judges are enforcing because we are using "colorable money." Colorable Admiralty is now known as Statutory Jurisdiction. Let's see how we got under this Statutory Jurisdiction.

UNIFORM COMMERCIAL CODE

The government set up a "colorable" law system to fit the "colorable" currency. It used to be called the Law Merchant or the Law of redeemable Instruments, because it dealt with paper, which was redeemable in something of substance. But, once Federal Reserve Notes had become unredeemable, there had to be a system of law which was completely "colorable" from start to finish. This system of law was codified as the Uniform Commercial Code and has been adopted in every state. This is "colorable" law, and it is used in all the courts.

I explained one of the keys earlier, which is that the country is bankrupt and we have no rights. If the master says "Jump!" then the slave had better jump, because the master has the right to cut off his head. As slaves we have no rights. But the creditors/masters had to cover that up, so they created a system of law called the Uniform Commercial Code. This "colorable" jurisdiction under the Uniform Commercial Code is the next key to understanding what happened.

CONTRACT OR AGREEMENT

One difference between Common Law and the Uniform Commercial Code is that in Common Law, contracts must be entered into (1) knowingly, (2) voluntarily, and (3) intentionally.

Under the U.C.C., this is not so. First of all, contracts are unnecessary. Under this new law, "agreements" can be binding and if you only exercise the benefits of an "agreement," it is presumed or implied that you intend to meet the obligations associated with those benefits. If you accept a benefit offered by government, then you are obligated to follow, to the letter, each and every statute involved with that benefit. The method has been to get everyone exercising a benefit and they don't even have to tell the people what the benefit is. Some people think it is the driver's license, the marriage license or the birth certificate, etc. I believe it is none of these.

COMPELLED BENEFIT

I believe the benefit being used is that we have been given the privilege of discharging debt with limited liability, instead of paying debt. When we pay a debt, we give substance for substance. If I buy a quart of milk with a silver dollar, that dollar bought the milk, and the milk bought the dollar - substance for substance. But if I use a Federal Reserve Note to buy the milk, I have not paid for it. There is no substance in the Federal Reserve Note. It is worthless paper given in exchange for something of substantive value. Congress offers us this benefit:

Debt money, created by the federal United States, can be spent all over the United States of America, it will be legal tender for all debts, public and private, and the limited liability is that you cannot be sued for not paying your debt.

So now they have said, "We going to help you out and you can just discharge your debts instead of paying your debts." When we use this "colorable" money to discharge our debts, we cannot use a Common Law court. We can only use a "colorable" court. We are completely under the UCC, using non-redeemable negotiable instruments and we are discharging debt rather than paying debt.

REMEDY AND RECOURSE

Every system of civilized law must have two characteristics: Remedy and Recourse. Remedy is a way to get out from under that law and you recover your loss. The Common Law, the Law Merchants, and even the Uniform Commercial Code all have remedy and recourse, but for a long time we could not find them. If you go to a law library and ask to see the Uniform Commercial Code, they will show you a shelf of books completely filled with the Uniform Commercial Code. When you pick up one volume and start to read it, it will seem to have been intentionally written to be confusing. It took us a long time to discover where the Remedy and Recourse are found in their UCC. They are found right in the first volume, at 1-308 (old 1-207) and 1-103.

REMEDY

The making of a valid Reservation of Rights preserves whatever rights the person then possesses, and prevents the loss of such rights by application of concepts of waiver or estoppel. (UCC 1-308 (old 1-207).7)

It is important to remember when we go into a court that we are in a commercial international jurisdiction. If we go into court and say, " I DEMAND MY CONSTITUTIONAL RIGHTS," the judge will most likely say, "You mention the Constitution again, and I'll find you in contempt of court!" Then we don't understand how he can do that. Hasn't he sworn to uphold the Constitution? The rule here is: you cannot be charged under one jurisdiction, and defend under another. For example, if the French government came to you and asked where you filed your French income tax in a certain year, do you go to the French government and say, "I demand my Constitutional Right?" No. The proper answer is: THE LAW DOESN'T APPLY TO ME - I'M NOT A FRENCHMAN. You must make your reservation of rights under the jurisdiction in which you are charged - not under some other jurisdiction. So in a UCC court, you must claim your reservation of rights under (pursuant to) the [their] U.C.C. 1-308 (old 1-207).

UCC 1-308 (old 1-207) goes on to say:

When a waivable right or claim is involved, the failure to make a reservation thereof, causes a loss of the right, and bars its assertion at a later date. (UCC 1-308 (old 1-207).9)

You have to make your claim known early. Further, it says:

The Sufficiency of the Reservation - Any expression indicating an intention to reserve rights, is sufficient, such as "WITHOUT PREJUDICE." (UCC 1-308 (old 1-207).4)

Whenever you sign any legal paper that deals with Federal Reserve Notes - in any way, shape or manner - under your signature write: Without Prejudice UCC 1-308 (old 1-207). This reserves your rights. You can show, at 1-308 (old 1-207.4) that you have sufficiently reserved your rights.

It is very important to understand just what this means. For example, one man who used this in regard to a traffic ticket was asked by the judge just what he meant by writing "without prejudice UCC 1-308 (old 1-207)" on his statement to the court. He had not tried to understand the concepts involved. He only wanted to use it to get out of the ticket. He did not know what it meant. When the judge asked him what he meant by signing in that way, he told the judge that he was not prejudiced against anyone .... The judge knew that the man had no idea what it meant and fined him an additional $25.00 for a frivolous defense. You must know what it means.

WITHOUT PREJUDICE
pursuant to UCC 1-308

When you see "Without Prejudice" UCC 1-308 in connection with your signature, you are saying:

"I reserve my right not to be compelled to perform under any contract, commercial agreement or bankruptcy that I did not enter knowingly, voluntarily, and intentionally. And furthermore, I do not and will not accept the liability of the compelled benefit of any unrevealed contract or commercial agreement or bankruptcy."

Actually, it is better to use a rubber stamp, because this demonstrates that you had previously reserved your rights. The simple fact that it takes several days or a week to order and get a stamp shows that you had reserved your rights before signing the document.

What is the compelled performance of an unrevealed commercial agreement? When you use Federal Reserve Notes instead of silver dollars, is it voluntary? No. There is no lawful money, so you have to use Federal Reserve Notes - you have to accept the benefit. The government has given you the benefit to discharge your debts with limited liability, and you don't have to pay your debts. How nice they are! But if you did not reserve your rights under 1-308 (old 1-207).7, you are compelled to accept the benefit, and are therefore obligated to obey every statute , ordinance and regulation of the government, at all levels of government - federal, state and local.

If you understand this, you will be asked to explain it to the judge when asks. And he will ask, so be prepared to explain it to the court. You will also need to understand UCC 1-103 - the argument and recourse.

If you want to understand this fully, go to a law library and photocopy these two sections from the UCC. It is important to get the Anderson [Anderson, Uniform Commercial Code, Lawyers Cooperative Publishing Company edition. Some of the law libraries will only have the West Publishing version, and it is very difficult to understand. In Anderson, it is broken down with decimals into ten parts, and most importantly, it is written in plain English.

RECOURSE

The Recourse appears in the Uniform Commercial Code at 1-103.6, which says:

The Code is complimentary to the Common Law, which remains in force, except where displaced by the code. A statute should be construed in harmony with the Common Law, unless there is a clear legislative intent to abrogate the Common Law.

This is the argument we use in court:

The Code recognizes the Common Law. If it did not recognize the Common Law, the government would have had to admit that the United States is bankrupt, and is completely owned by its creditors. But, it is not expedient to admit this, so the Code was written so as not to abolish the Common Law entirely. Therefore, if you have made a sufficient, timely, and explicit reservation of your rights at 1-308 (old 1-207), you may then insist that the statutes be construed in harmony with the Common Law.

If the charge is a traffic violation, you may demand that the court produce the injured person who has filed a verified complaint. If, for example, you were charged with failure to buckle your seatbelt, you may ask the court who was injured as a result of your failure to "buckle up."

However, if the judge won't listen to you and just moves ahead with the case, then you will want to read to him that last sentence of 1-103.6 which states:

The Code cannot be read to preclude a Common Law action.

Tell the judge:

"Your Honor, I can sue you under the Common Law, for violating my right under the Uniform Commercial Code." I have a remedy, under the, UCC to reserve my rights under the Common Law. I have exercised the remedy, and now you must construe this statute in harmony with the Common Law, you must come forth with the damaged party."

If the judge insists on proceeding with the case, just act confused and ask this question:

"Let me see if I understand, Your Honor. Has this court made a judicial determination that the sections 1-308 (old 1-207) and 1-103 of the Uniform Commercial Code, which is the system of law you are operating under, are not valid law before this court?"

Now the judge is in a jamb! How can the court throw out one part of the Code and uphold another? If he answers, "yes," then you say:

"I put this court on notice that I am appealing your judicial determination."

Of course, the higher court will uphold the Code on appeal. The judge knows this, so once again you have boxed him into a corner.

PRACTICAL APPLICATION - TRAFFIC COURT

Just so we can understand how this whole process works, let us look at a court situation such as a traffic violation. Assume you ran through a yellow light and a policeman gave you a traffic ticket.

1. The first thing you want to do is to delay the action at least three weeks. This you can do by being pleasant and cooperative with the officer. Explain to him that you are very busy and ask if he could please set your court appearance for about three weeks away.

[At this point we need to remember the government's trick: "I'm from the government, and I'm here to help you." Now we want to use this approach with them).

2. The next step is to go the clerk of the traffic court and say:

"I believe it would be helpful if I talk to you, because I want to save the government some money (this will get their attention). I am undoubtedly going to appeal this case. As you know, in an appeal, I have to have a transcript, but the traffic court doesn't have a court reporter. It would be a waste of taxpayer's money to run me through this court and then to have to give me a trial de novo in a court of record. I do need a transcript for appealing, and to save the government some money, maybe you could schedule me to appear in a court of record."

You can show the date on the ticket and the clerk will usually agree that there is plenty of time to schedule your trial for a court of record. Now your first appearance is in a court of record and not in a traffic court, where there is no record.

3. When you get into court, the judge will read the charges: driving through a yellow light or whatever, and this is a violation of ordinance XYZ. He will ask, " Do you understand the charges against you?"

4. It is very important to get it read into the record, that you do not understand the charges. With that in the record, the court cannot move forward to judge the facts. This will be answered later.

5. "Well, Your Honor, there is a question I would like to ask before I can make a plea of innocent or guilty. I think it could be answered if I could put the officer on the stand for a moment and ask him a few short questions.

Judge: "I don't see why not. Let's swear the officer in and have him take the stand."

"Is this the instrument that you gave me?" (Handing him the traffic citation).

Officer: "Yes, this is a copy of it. The judge has the other portion of it."

"Where did you get my address that you wrote on that citation?"

Officer: "Well, I got it from your driver's license."

(Handing the officer your driver's license) "Is this the document you copied my name and address from?"

Officer: "Yes, this is where I got it."

"While you've got it in your hand, would you read the signature that's on that license? (The officer reads the signature). "While you're there, would you read into the record what it says under the signature?"

Officer: "It says, "Without Prejudice, UCC 1-308 (old 1-207)."

Judge: "Let me see that license!" (He looks at it turns to the officer). "You didn't notice this printing under the signature on this license, when you copied his name and address onto the ticket?"

Officer: "Oh, no, I was just getting the address - I didn't look down there."

Judge: "You're not very observant as an officer. Therefore, I'm afraid I cannot accept your testimony in regards to the facts of this case. This case is dismissed."

6.a. you had reserved your Common Law rights under the UCC;

b. you had done it sufficiently by writing "Without Prejudice, UCC 1-308 (old 1-207)" on your driver's license;

c. the statute would now have to be read in harmony with the Common Law, and the Common Law says the statute exists, but there is no injured party; and

d. since there is no injured party or complaining witness, the court has no jurisdiction under the Common Law.

5. If the judge tries to move ahead and try the facts of the case, then you will want to ask him the following question:

"Your Honor, let me understand this correctly, has the court made a judicial determination that it has authority under the jurisdiction that it is operating under, to ignore two sections of the Uniform Commercial Code which have been called to its attention? If he says, yes, tell him that you put the court on notice that you will appeal that judicial determination, and that if you are damaged by his actions, you will sue him in Common Law action - under the jurisdiction of the U.C.C."

QUESTIONS AND REVIEW

Note: These are some of the questions asked after the main lecture. Some are restatements of material presented earlier, but they contain very valuable information which is worth repeating.

COURTROOM TECHNIQUES

Question: How did you "box in" the judge?

This is easy to do if you don't know too much. I didn't know too much, but I boxed them in. You must play a little ignorant.

If you are arrested and you go to court, just remember that in a criminal action, you have to understand the law or it is a reversible error for the court to try you. If you don't understand the law, they can't try you.

In any traffic court case or tax case you are called into court and the judge reads the law and then asks, "Do you understand the charges?"

Defendant: No, (Your Honor,) I do not!

Judge:

Well, what's so difficult about that charge? Either you drove the wrong way on a one-way street or you didn't. You can only go one way on that street, and if you go the other way, it's a fifty dollar fine. What's so difficult about this that you don't understand?"

D: Well, Your Honor, it's not the letter of the law, but rather the nature of the law that I don't understand. The Sixth Amendment of the Constitution gives me the right to request the court to explain the nature of any action against me, and upon my request, the court has the duty to answer. I have a question about the nature of this action.

J: Well, what is that - what do you want to know?

Always! Ask them some easy questions first, as this establishes that they are answering. You ask:

D: Well, Your Honor, is this a Civil or Criminal Action?"

J: It is criminal. (If it were a civil action there could be no fine, so it has to be criminal).

D: Thank you, Your Honor, for telling me that. Then the record will show that this action against ___(Straw Man Name)___ is a criminal action, is that right?

J: Yes.

D: I would like to ask another question about this criminal action. There are two criminal jurisdictions mentioned in the Constitution; one is under the Common Law, and the other deals with International Maritime Contracts, under an Admiralty Jurisdiction. Equity is Civil, and you said this is a Criminal action, so it seems it would have to be under either the Common Law, or Maritime Law. But what puzzles me, Your Honor, is, there is no Corpus Delicti here that gives this court a jurisdiction over my person and property under the Common Law. Therefore, it doesn't appear to me that this court is moving under the Common Law.

J: No, I can assure you this court is not moving under the Common Law.

D: Well, thank you, your Honor, but now you make the charge against me even more difficult to understand, the only other criminal jurisdiction would apply only if there was an International Maritime Contract involved and I was a party to it, it had been Breached, and the court was operating in an Admiralty Jurisdiction.

I don't believe I have ever been under any International Maritime Contract, so I would deny that one exists. I would have to demand that such a contract, if it does exist, be placed into evidence, so that I may contest it, but surely, this court is not operating under an Admiralty Jurisdiction.

You just put words in the judge's mouth.

J: No, I can assure you, we're not operating under an Admiralty Jurisdiction. We're not out in the ocean somewhere - we're right here in the middle of the State of North Carolina, No, this is not an Admiralty Jurisdiction.

D: Thank you, Your Honor, but now I am more puzzled than ever. If this/these charge/s is/are not under the Common Law, or under Admiralty - and those are the only criminal jurisdictions mentioned in the Constitution - what kind of jurisdiction could this court be operating under?

J: It's Statutory Jurisdiction.

D: Oh, thank you, Your Honor. I'm glad you told me that. But I have never heard of that jurisdiction. So, if I have to defend under that, I would need to have the Rules of Criminal Procedure for Statutory Jurisdiction. Can you provide me with the location of a copy?

There are two more names of major significance for the year 1938.

The names are forever etched in the history of our judicial branch, and yet the every day American never knew and was never informed.

Erie Railroad v. Tompkins. Sounds obscure and unimportant enough, doesn't it?

It was a simple case of a corporations unkept property causing injury to a man, a natural man.

To set the stage, a man by the name of Tompkins was walking along a railroad track one day. A train, owned by Erie Railroad, came along. A board sticking off a box car caught the man, and ingured him.

This particular man, Tompkins, was not an employee of Erie Railroad. Remember that.

So, Tompkins sues Erie Railroad for physical damages, his lawyer recalling a standing case, from a Supreme Court decision in 1848, Swift v. Taylor. He is awarded damages, $30,000.00, by Federal District Court in New York.

What happened with the Supreme Courts reversal decision with Erie Railroad v Tompkins was monumental.

The Supreme Court ruled in the Erie Railroad v. Tompkins case...."that ALL FEDERAL cases will be judged under the NEGOTIABLE INSTRUMENTS law. There would be NO MORE decisions based on the Common Law, at the federal level"......NOTE, they did not refer to our Common Law.

That single decision overturned a STANDING case of 90 years. A STANDING Supreme Court decision overturned by the same Supreme Court. That is incredulous!!

However, what is even more incredulous is the decision to judge federal cases based on NEGOTIABLE INSTRUMENTS Law, or Admiralty/ Maritime Law.

With that single case we went from Common Law to Equity, NEGOTIABLE INSTRUMENTS, Admiralty/ Maritime Law.

This was necessary for the international bankers to seal our sovereign fate and hold us as bonded serfs....subjects....VOLUNTARY slaves.....US Citizens.

This one Supreme Court judgment gave the bankers the royal flush!! They now out right own every branch of our govt.! The Executive, via Lincoln's 15 April 1861, Executive Order No. 1/ Liber Codes, the Legislature, via the Federal Reserve Act of 1913, and then in 1938, the Judicial, via Erie Railroad v Tompkins! As plain as the nose on our faces, folks. See the pattern for control?

The bankers get their will accomplished by getting legislation to the POTUS's desk for a wet ink signature, and the courts to have their backs.

Why in the heck do you think they call legislation, "BILLS"? Because it is intended for someone to PAY for that PUBLIC POLICY. No tin foil hats here, either!! Just plain and simple common sense, logic, and reason.

Judges today will not entertain any standing cases that predate 1938. To Judges of Equity, they simply do not exist.

Also, by placing the judicial system under Equity it allows for prosecution and penalties based on statutes and public policies, which is a scheme whereby one can be robbed, without immunity, or remedy.

Under Common Law, unless someone gets hurt, damaged, murdered, and property is not damaged, there is no crime, therefore no punishment.

Our Judicial system is simply about balancing accounting ledgers, and judges, (administrative officers), are simply bankers satifying credits and debits columns.

A traffic ticket is an invoice, a bill, and the bearer will pay, regardless of whether they were in the right.

An indictment is a bill of presentment, that inevitably someone will pay.

When one receives a summons, it is not the physical person being summonsed, but their, "STRAWMAN", to pay a bill.

Remember, artificial entities cannot interact with real entities, men or women.

If you have a court summons, take a hard look at your name, and at the name of the court. One will notice one thing. CAPITIS DIMINUTIO MAXIMA. Your name is in all upper case.

A summons is nothing more than an invitation to go before a judge to pay a debt, plain and simple.

Our current court system is designed to keep us in bondage, bonded, a willing slave, when in fact, we as humans are endowed with CERTAIN in-a-LIEN-able rights.

Now, I am not lawyer. Don't want to be and I don't play one on T.V. However, I am no idiot, and can read.....even big words!! And from what I have read, and understand, I can clearly see where the line in the sand was drawn, with regards to our judicial system, and how it was changed, secretly, to enslave us even more.

And if you don't believe me, call on any judge in this land, ask them in their court point blank why judges do not acknowledge standing decisions pre-1938! Some will look at you blankly, some will go stone white, and other may tell you they cannot discuss the issue.

What the banking elite are doing is controlling our lives and stealing our money, the fruits of our labors, and then try to tell us that it is a benefit and privilege!!

For example.

It is for YOUR safety, as a contracted driver, on their corporate channels that YOU wear your seat belt, or PAY a FINE....a LIEN, for not being in compliance with public policy, for the privilege of operating a vehicle. And a judge will have no problem demanding payment.

This is just one simple illustration.

See the set up? And how it is designed to appear legitimate? Now, how in the world is one person not wearing their seat belt hurting anyone or destroying anyone's property? NO CRIME, but public policy creates crime, categorizes it, and puts a price on it to create another conduit for cash flow.....from your account to theirs. It is really that simple. It's about DEBITS/ CREDITS and SUPPLY/ DEMAND.

Folks, it's as simple as following the money!!

We have already verified THE SUPREME COURT is a corporation. WHO would be their SHAREHOLDERS? Bankers is at the top of the list, just like commercial corporations.

So, just remember that when you go before a judge, as a defendant, he is an administrative officer for the banks, and he is expecting you to plea to pay.

But, here's the KICKER (THE MONEY TRAIL).

If the Cap & Trade bill passes, it is estimated that over 10 TRILLION dollars each year will be traded on the CXX exchange. At a commission rate of only 4 percent, the exchange would earn close to 400 billion dollars to spit between its owners, all Obama cronies. At a 2 percent rate, Goldman Sachs would also rake in 200 billion dollars each year.

But don't forget ShoreBank. With 10 trillion dollars flowing though its accounts, the bank will earn close to 40 billion dollars in interest each year for its owners (more Obama cronies), without even breaking a sweat.

It is estimated Al Gore alone will probably rake in 15 billion dollars just in the first year. Of course, Obama's"commissions " will be held in trust for him at the JOYCE FOUNDATION. They are estimated to be over 8 billion dollars by the time he leaves office in 2013, if the bill passes this year. Of course, these commissions will continue to be paid for the rest of his life.

Financial experts think this will be the largest "scam" or "legal heist" in world history. Obama's cronies make the Mafia look like rank amateurs. They will make Bernie Madoff's fraud look like penny ante stuff.

This story has been put together from various articles and TV shows by the British Times paper. It shows what Obama and his friends are really all about. It's not hope and change, it is money.

A small bank in Chicago called ShoreBank almost went bankrupt duringthe recession.
The bank made a profit on its foreign micro-loans (see below) but had lost money in sub-prime mortgages in the US . It was facing likely closure by federal regulators. However, because the bank's executives were well connected with members of the Obama Administration, a private rescue bailout was arranged. The bank's employees had donated money to "Obama's Senate campaign". In other words, ShoreBank was too politically connected to be allowed to go under.

ShoreBank survived and invested in many "green" businesses such as solar panel manufacturing. In fact, the bank was mentioned in one of Obama's speeches during his election campaign because it subjected new business borrowers to eco-litmus tests.

Prior to becoming President, Obama sat on the board of the JOYCE FOUNDATION, a liberal charity. This foundation was originally established by Joyce Kean's family which had accumulated millions of dollars in the lumber industry. It mostly gave funds to hospitals but after her death in 1972, the foundation was taken over by radical environmentalists and social justice extremists.

This JOYCE FOUNDATION, which is rumored to have assets of 8 billion dollars, has now set up and funded, with a few partners, something called the CHICAGO CLIMATE EXCHANGE, known as CXX. It will be the exchange (like the Chicago Grain Futures Market for agriculture) where Environmental Carbon Credits are traded.

Under Obama's new bill, businesses in the future will be assessed a tax on how much CO2 they produce (their Carbon Footprint) or in other words how much they add to global warming. If a company produces less CO2 than their allotted measured limit, they earn a Carbon Credit. This Carbon Credit can be traded on the CXX exchange. Another company, which has gone over their CO2 limit, can buy the Credit and "reduce" their footprint and tax liability. It will be like trading shares on Wall Street.

Well, it was the same JOYCE FOUNDATION, along with some other private partners and Wall Street firms that funded the bailout of ShoreBank. The foundation is now one of the major shareholders. The bank has now been designated to be the "banking arm" of the CHICAGO CLIMATEEXCHANGE (CXX). In addition, Goldman Sachs has been contracted to run the investment trading floor of the exchange.

So far so good; now the INTERESTING parts.

One ShoreBank co-founder, named Jan Piercy, was a Wellesley College roommate of Hillary Clinton. Hillary and Bill Clinton have long supported the bank and are small investors.

Another co-founder of ShoreBank, named Mary Houghton, was a friend of Obama's late mother. Obama's" mother worked on foreign MICRO-LOANS for the Ford Foundation. She worked for the foundation with a guy called Geithner. Yes, you guessed it. This man was the father of Tim Geithner, our present Treasury Secretary, who failed to pay all his taxes for two years.

Another founder of ShoreBank was Ronald Grzywinski, a cohort and close friend of Jimmy Carter.

The former Shore Bank Vice Chairman was a man called Bob Nash. He was the deputy campaign manager of Hillary Clinton's presidential bid. He also sat on the board of the Chicago Law School with Obama and Bill Ayers, the former terrorist. Nash was also a member of Obama's">White House transition team.

(To jog your memories, Bill Ayers is a Professor at the University of Illinois at Chicago . He founded the Weather Underground, a radical revolutionary group that bombed buildings in the 60s and 70s. He had no remorse for those who were killed, escaped jail on a technicality, and is still an admitted Marxist).

When Obama sat on the board of the JOYCE FOUNDATION, he "funneled" thousands of charity dollars to a guy named John Ayers, who runs a dubious education fund.
Yes, you guessed it. The brother of Bill Ayers, the terrorist.

Howard Stanback is a board member of ShoreBank. He is a former board chairman of the Woods Foundation. Obama and Bill Ayers, the terrorist, also sat on the board of the Woods Foundation. Stanback was formerly employed by New Kenwood Inc. a real estate development company co-owned by Tony Rezko.

(You will remember that Tony Rezko was the guy who gave Obama an amazing sweet deal on his new house. Years prior to this, the law firm of Davis, Miner, Barnhill & Galland had represented Rezko's company and helped him get more than 43 million dollars in government funding. Guess who worked as a lawyer at the firm at the time. Yes, Barack Obama).

Adele Simmons, the Director of ShoreBank, is a close friend of Valerie Jarrett, a White House senior advisor to Obama. Simmons and Jarrett also sit on the board of a dubious Chicago Civic Organization.

Van Jones sits on the board of ShoreBank and is one the marketing directors for "green" projects. He also holds a senior advisor position for black studies at Princeton University . You will remember that Mr. Van Jones was appointed by Obama in 2009 to be a Special Advisor for Green Jobs at the White House. He was forced to resign over past political activities, including the fact that he is a Marxist. Here's the rest of the line-up...and the end result that will affect YOU

Al Gore was one of the smaller partners to originally help fund the CHICAGO CLIMATE EXCHANGE. He also founded a company called Generation Investment Management (GIM) and registered it in London , England. GIM has close links to the UK-based Climate Exchange PLC, a holdingcompany listed on the London Stock Exchange. This company trades Carbon Credits in Europe (just like CXX will do here) and its floor is run by Goldman Sachs.

Along with Gore, the other co-founder of GIM is Hank Paulson, the former US Treasury Secretary and former CEO of Goldman Sachs. His wife, Wendy, graduated from and is presently a Trustee of Wellesley College. Yes, the same college that Hillary Clinton and Jan Piercy, a co-founder of ShoreBank attended. (They are all friends).

Because many studies have been exposed as scientific nonsense, people are slowly realizing that man-made global warming is nothing more than a money-generating hoax.

As a result, Obama is working feverishly to win the race. He aims to push a Cap-and-Trade Carbon Tax Bill through Congress and into law.

Obama knows he must get this passed before he loses his majority in Congress in the November elections. Apart from Climate Change he will "sell" this bill to the public as generating tax revenue to reduce our debt. But, it will also make it impossible for US companies to compete in world markets and drastically increase unemployment. In addition, energy prices (home utility rates) will sky rocket.

Has anyone ever wondered why our government seems to do as it wishes, contrary to their "constituents" wishes, no matter which party is in power? And folks, we have been plagued with this problem for almost 140 years! Yes, seriously, 140 years! Certainly anyone with a single cell brain can tell that something is not connecting between "We the people", and the very government "We the people" called into being, especially so nowadays, right? NObamascare, of which TWO states have gathered the cajonas to fight, so far, should be a HUGE red flag to anyone, right? Government FORCED healthcare. A mandate is an enforcement policy, whether anyone of "We the people" agree with it or not. And yet despite the unpopulararity of the bill with a majority of Americans, the BILL was crammed down our throats. And Nancy Pelosi said we couldn't see what was in it, without first passing it!!! That's like wheeling and dealing for door number three, and then it turns out to be the boobie prize. Does that sound like an environment where "We the people" are in control, of the very government, "we the people" created? Didn't think so either. And mind you, I don't have a tin foil hat in my hat collection. Also, take into consideration that I have been having these serious questions and conversations with myself, as most people didn't, and still don't take "conspiracy theories" very seriously. And then the internet age took off, and holy bat poopoo, the information started flowing, and is authenticated and verifiable, so there is no more any need to ignore it, or try to prove otherwise!! My opinion. Okay, so in previous blogs we have discussed what a US Citizen is and we touched on THE UNITED STATES. Now we are going to dig into WHO and or WHAT is THE UNITED STATES. We will start with The Act of 1871, also known as the District Of Columbia Organic Act of 1871. Notice that that Act followed just 10 years behind the adjourning sine die of the de jure Congress. And I am sure that there are some of you who call into question as to what a US Citizen actually is. I know I did, and learned something entirely different than what I learned in History or Civics.
US Citizen. Let's put it in its full context.
UNITED STATES Citizen. Or, how about VOLUNTARY servitude.
When we study citizenship and the 14th Amendment, of the de facto government CONSTITUTION, we need to go back to April 15, 1861.
On that date Abraham Lincoln, POTUS, reconvened both the House and the Senate, under a self executed proclamation, because the Congress had adjourned sine die.
What is significant is that President Lincoln was the chief of a three man committee, that was organized, (President, VP, Speaker of the House).
This committee's job was to manage the affairs of the govt., Civil War, Treasury, during the declaration of emergency, as declared by Lincoln.
Knowing who this committee is, now, next time you see the POTUS addressing both chambers of Congress, take notice of the VP behind to the POTUS right and SOH on left. The three man committee is present at every address.
The Declaration of war, never to be lifted, continues unabated.
To this day EVERY President has declared some kind of war, during their tenure.
And ten years later, after 1861, the corporation known as THE UNITED STATES was formed.
But it took a secession of the southern states, to put Congress in sine die.
Think about that for a sec.

It is common knowledge that banks fund both sides of any war campaign, and war is their greatest profit maker.

In 1933 the de facto corporate effect, aka, THE UNITED STATES, went bancrupt.

FDR confiscates all of the gold, turning it over to the FED.

On top of that, THE UNITED STATES needed MORE collateral, to securitize the bancruptcy loan and receivership.

They decided to use the American people as CHATTEL, PROPERTY, or collateral.

So, they issue every birthed infant a number, that is basically an inventory receipt, through the Sheppard-Towner Act.

Mind you, all of this falls under Admiralty/ Maritime Law, the Uniform Commercial Codes, and the UNITED STATES Codes.

So a corporation was created, that bore your name, Capitus Diminutio Maximus, according to your birth certificate.

Ficticious personas cannot interact with natural men, but they can interact with a ficticious persona, and call it a corporation, a viola!! Your "STRAWMAN". And it is legal under the Uniform Commercial Code and the UNITED STATES code.

As the USC Title 28 3002 15.(a) states, THE UNITED STATES is a federal corporation, and the "dummy" corporation, spoken of by Edward Mandell House.

What is important is the essence of the content. And boy, we are going to be going places here.

AMERICANS REALLY NEED TO START WAKING UP.

Have you literally stopped in your tracks, took a long look around your surroundings, and just asked yourself, "Is this our real reality?" "Am I really a free, natural man?"

May I indulge you with some thoughts of my own?

I actually have considered and can rationalize that our present reality is not our real reality. It is a mere contrivance, a spectacle, the grand Illusion and all the world is the stage.

And I also believe that none of us is free, in what is touted as a "free" country.

I know, some one is reading this and saying bullshit, so I have a little exercise for you, permitting you are willing to go along with me to prove my viewpoint. Fair?

Right now, take out your birth certificate, the certified copy, your SS card, drivers license. Grab a utility bill, look at your bank signature card, vehicle registration, Insurance card, just to name a few.

There is one thing in common on all of the listed documents.

Your name will be in all UPPER CASE, like this JOHN DOE PUBLIC.

Now one may think that that fact does not matter to them, but I would beg to differ.

Remeber your birth certificate? The upper case spelling of your name? Now feel the border design. Should be embossed, and at the bottom it should say somewhere "printed on bonded paper", or something to that effect. And there should also be a series of six to eight red numbers on it.
